Know Your IEP Rights
Step 1: Read the rights every parent has. Step 2: Pick your state. Step 3: Use the words at your next meeting.
Rights in every state
Free testing
You can ask the school, in writing, to test your child. Testing is free.
60-day clock
After you sign consent, the school has 60 days to finish testing, unless your state sets its own clock.
Written notice
The school must tell you in writing before it changes or refuses anything in the IEP.
Bring anyone
You can bring a friend, advocate, or helper to any IEP meeting.
You can disagree
You do not have to sign. You can ask for mediation, file a state complaint, or ask for a hearing.
Outside testing
If you disagree with the school's testing, you can ask for an outside test at no cost to you.
Stay-put
While you disagree, your child keeps the current services.
Your records
You can see your child's school records. The school must answer within 45 days.
Discipline protection
After 10 days out of school, the school must hold a meeting to check if the behavior is from the disability.
